Basics of law: questions for the patent exam

This page covers the basics of law only — the third module of the patent exam. The exam has six such tasks; there are eighteen here, that is three different sets.

This module differs from the other two in being useful even without the exam. The questions are about exactly what people stumble over in real life: who registers you for migration purposes, whether you may work on your patent in another region, whether an employer may take your passport, what to do if you lose it.

  1. Что может грозить иностранному гражданину за нарушение миграционных правил?

    Breaking migration rules carries an administrative fine and removal from the Russian Federation. Removal brings with it a ban on re-entry for a set period, so the consequence does not end when you leave. That is why seemingly small violations — lapsed registration, working outside your stated occupation — cost far more than they appear to.

  2. Работодатель забрал ваш паспорт «на хранение до конца работы». Законно ли это?

    Your passport is a personal document, and no employer, agent or landlord has the right to take it. Demanding that you “leave the passport” is a common coercion tactic: without it you can neither leave nor seek help. If your passport is being withheld, go to the police and to your country’s consulate.

  3. Куда обращаться иностранному работнику, если работодатель не платит зарплату?

    A foreign worker’s labour rights are protected like a citizen’s: you can go to the state labour inspectorate or to court. You will need the written employment contract — the second copy the employer is obliged to give you. That is why you take the contract straight away rather than “later”: without it, proving the relationship is far harder.

    If you lose your passport, report it to the police at once and contact your country’s embassy or consulate — only they can issue a passport. The police report proves the document was lost rather than hidden, which matters at any check before the replacement arrives. Never buy a “document” from an agent: that is forgery and a criminal offence.

  5. Иностранный гражданин из безвизовой страны работает без патента. Как это оценивается?

    A citizen of a visa-free country needs a patent to work in Russia. Working without one is a violation, and both sides answer for it: the employer is fined for engaging the worker, the worker faces penalties up to removal. “We agreed verbally” and “it was only a few days” do not remove liability.

  6. При оформлении документов посредник предлагает указать несуществующий адрес проживания. Чем это грозит?

    Registering at an address where you do not actually live is fictitious registration. For the receiving party it is a criminal offence; for the foreign national it means removal from the register, a fine and the risk of expulsion. The agent who suggests it appears nowhere on the paperwork and bears no liability — you will.

  7. Срок вашего пребывания в России заканчивается, а законных оснований продлить его нет. Что нужно сделать?

    If your period of stay is running out and there is no lawful basis to extend it, you must leave Russia before it ends. Overstaying is a violation leading to fines, removal and an entry ban, and every extra day makes it worse. Leaving on time and returning lawfully is almost always cheaper than staying and being banned.

  8. Работодатель забрал ваш паспорт и не отдаёт. Что это?

    A passport is its holder’s personal document, and neither an employer nor an agent may keep it. If it is not returned, go to the police: this is not a labour dispute but the withholding of someone’s document.

    A foreign national must carry an identity document and documents confirming the right to be in Russia, and present them on an official’s demand.

    Working without authorisation is one of the commonest violations: it carries a fine and administrative removal, and after removal a ban on entry.

  11. Что означает «запрет на въезд»?

    An entry ban closes the way to Russia for three years or more, depending on the violation. It is among the harshest consequences: the person loses their job, their home and contact with family left behind.

  12. Кто подаёт уведомление о прибытии иностранного гражданина?

    As a rule the notification is filed by the host party — whoever the person actually lives with. The deadline is seven working days, or one working day in a hotel.

    Emergency medical care for sudden life-threatening conditions is provided free and without delay — to foreign nationals too. Planned care goes through insurance or is paid for.

    A patent is a work permit for citizens of countries with visa-free entry. It does not give the right of permanent residence and does not bring you closer to citizenship. The right to live and the right to work are different rights, confirmed by different documents.

  15. Что такое миграционный учёт?

    Migration registration means notifying the state of where a foreign national is staying. The receiving party does it: the owner of the accommodation, a hotel, or an employer providing housing. Registration does not grant the right to work and does not replace taxes.

  16. В какой форме заключается трудовой договор?

    An employment contract is concluded in writing, in two copies — one stays with the employee. If you were not given your copy, that is already a violation. This question comes up often in the exam, because this is where people are most often deceived.

  17. Сотрудник полиции остановил вас на улице и просит документы. Что нужно сделать?

    The police are entitled to check identity documents. You must present the documents — that is, show them, not hand them over for good. The officer must introduce themselves and state the reason for the stop; you are entitled to ask to see their service ID.

  18. Что такое фиктивная регистрация?

    Fictitious registration means being registered at an address where the person does not actually live. Responsibility falls first on the receiving party — the owner of the accommodation — and for them it is a criminal offence. The foreign national is removed from the register and becomes a violator of the rules of stay, which means a fine and expulsion. That is why agreeing to «registration for money» at someone else's address is dangerous for both sides, and especially for you: it is you who will have to leave, not the person who sold the paper.

  19. Какой документ подтверждает личность иностранного гражданина в России?

    The identity of a foreign national is confirmed by the passport of their own state. The other documents — the migration card, the notice of registration, the patent — confirm not identity but particular circumstances: entry, place of stay, the right to work.

  20. Вы получили патент в одном регионе. Можно ли работать по нему в соседнем регионе?

    A patent is issued for, and valid in, one specific region of Russia. Working in another region requires a patent from that region. This is one of the most common reasons for fines: people follow the work and do not notice that the document stayed behind.

    Only citizens of the Russian Federation may vote or stand for state office. A foreign national has the right to work, to medical care, to defence in court and to education — but not the vote. The exam often asks you to separate these two sets of rights.

  22. Можно ли передать свой патент другому человеку, чтобы он поработал вместо вас?

    A patent is a personal document bearing the holder’s name and photograph. Nobody may work on someone else’s patent under any circumstances. The same applies to the migration card and the registration slip: each is issued to one named person.

  23. Кто ставит иностранного гражданина на миграционный учёт по месту пребывания?

    Migration registration is the duty of the receiving party — the property owner, the hotel, or the employer if the employer provided the housing. Once the notification is filed you must be given the detachable stub with a stamp: that is your proof of registration. Keep it with your passport.

  24. Вы работаете по патенту водителем, а работодатель просит выйти на другую работу — продавцом. Что здесь важно знать?

    The patent states the occupation you are permitted to work in. Working in a different occupation counts as a violation, even with the same employer and a proper contract. If the job changes, you must apply to the migration office to amend the document — a verbal arrangement is not enough.

The explanation of each wrong option does not say “the law says so” — it explains why the mistake looks plausible. It seems logical, for instance, that a patent should be valid across the whole country: in fact it is the exam certificate that is valid nationwide, while the patent is tied to its region, and that is where people most often lose money.

Numbers we could not verify against a primary source are absent here: periods of stay, fine amounts and the length of entry bans change with each amendment of the law, and an invented number is worse than none.
